Terms of Service

1. Who we are

Spotted.gi is operated by the operators of Spotted.gi. Contact: support@spotted.gi.

2. The service

Spotted.gi lets you discover and claim digital collectibles by scanning QR codes and/or visiting locations (subject to proximity rules), build a collection, use Ping to find nearby items, and appear on a leaderboard. Features may change, and some collectibles may be time-limited, inactive, or soft-deleted.

3. Eligibility

You must be at least 13 years old to use Spotted.gi. If you are under the age of digital consent in your jurisdiction but at least 13, you should only use the service with appropriate parental/guardian involvement where required.

4. Accounts

• You sign in with Google. You are responsible for securing your Google account.
• You must choose a unique username. Usernames cannot be changed later.
• Reserved or abusive usernames are not allowed; we may reclaim or block them.
• One person should not create multiple accounts to manipulate the leaderboard.

5. Location and device permissions

Some features require location permission. You agree that location you provide is for legitimate use of Ping and proximity claims only. Spoofing location, bypassing QR claim codes, or abusing APIs is prohibited.

6. Acceptable use

You agree not to:

• Interfere with the service, other users, or venue partners
• Scrape, reverse engineer, or attempt to extract claim codes or secret location data
• Harass others or use offensive usernames or content
• Use the service for unlawful purposes

7. Collectibles and intellectual property

Digital collectibles are licensed for personal, non-commercial enjoyment within Spotted.gi. They do not confer ownership of underlying artwork, trademarks, or venue brands unless expressly stated. Spotted.gi branding, software, and content remain our property or that of our licensors. Venue partners retain rights in their own marks and premises.

8. Partner venues

QR codes and placements at partner venues are courtesy placements. We and venue partners are not responsible for temporary removal, damage, or inaccessibility of physical materials.

9. Availability and changes

We provide Spotted.gi on an "as is" and "as available" basis. We may modify, suspend, or discontinue features without liability, including leaderboard resets or collectible changes needed for operations or fairness.

10. Limitation of liability

To the fullest extent permitted by applicable law in Gibraltar and the UK, we are not liable for indirect, incidental, or consequential damages arising from use of the service. Nothing in these Terms excludes liability that cannot be excluded by law (including for death or personal injury caused by negligence, or fraud).

11. Privacy

Personal data is handled as described in our Privacy Policy.

12. Termination

We may suspend or terminate access if you breach these Terms or abuse the service. You may stop using Spotted.gi at any time. For account deletion requests, contact support@spotted.gi.

13. Governing law

These Terms are governed by the laws of Gibraltar, without prejudice to mandatory consumer protections that may apply where you live in the UK or elsewhere.
